These terms govern the use of this website. They are not the terms of a hire: those are a separate document at rental terms, and they are the ones that matter once you are actually taking a car. Nothing on this website is an offer you can accept by clicking. Sending an enquiry starts a conversation, and a person confirms everything before anything is agreed.
Who runs this website?
This website is operated by the business trading as Performance & Prestige. The registered legal entity behind that trading name, its company number and its registered office are being confirmed before launch and will be printed here. Owner to confirm
In these terms, “we”, “us” and “our” mean that business. “You” means anyone using this website. Contact us at [email protected].
Using the site means accepting these terms
If you do not accept them, please stop using the site. Accepting them does not commit you to hiring anything and does not create any contract for a vehicle.
How should I read the rates and the cars?
This is the part of these terms worth actually reading, because it changes what a page here means.
- Nothing here is an offer you can accept.
- A rate, a car or an availability state on this site is an invitation to enquire. A hire comes into existence only when we have confirmed the vehicle, the dates, the driver and the full cost with you, and you have agreed to it.
- A car we own and a car we can source are different things.
- Cars badged “in our fleet” are ours: we own them, prepare them and deliver them, and we are the hire company. Cars badged “we can source” are arranged through a vetted partner, so the rate shown is a guide, availability is subject to confirmation, and we tell you who is supplying the car before anything is agreed. - Rates include VAT, and the cost stack is separate.
- Day, weekend, week and month rates are inclusive of VAT. The refundable security deposit, the insurance excess, the mileage allowance and delivery are separate figures, and they are on each car’s page above any form rather than after it.
- Specifications and images are descriptive.
- Images are representative studio renderings of the model, not photographs of the individual vehicle. We take care to keep the technical details right, but a manufacturer figure quoted here is not a term of your hire. If a specific feature matters to you, ask us to confirm it for the actual car before you book.
- We can change what is on the site.
- Rates, availability and the catalogue change. What does not change is that a price we have confirmed to you in writing for specific dates is the price, whatever the site says the following week.
Does sending an enquiry commit me to anything?
No. It is a request for availability and a price, and it reserves nothing. There is no checkout on this website and no payment, deposit or card detail is taken through it at any point.
When you send one, please give us details that are accurate, particularly the driver’s age and licence history. Those decide whether a car can be insured for that driver, so an answer built on a wrong one is worth nothing to either of us. What we do with what you send is set out in the privacy policy.
We may decline an enquiry or a booking. We do not have to give a reason, but in practice it is almost always the insurance conditions for that vehicle.
What may I not do with the site?
Use it as much as you like, for your own purposes, including saving pages and sending them to somebody. What is not permitted:
- Copy, scrape or republish the content, the photography or the vehicle data for a competing service.
- Use the enquiry form for anything other than a genuine enquiry, or send us anything unlawful or abusive through it.
- Try to break, overload or gain unauthorised access to the site or the systems behind it.
- Introduce anything malicious, or use an automated tool to harvest data from the pages.
- Present yourself as us, or use our name or marks in a way that suggests we endorse something we do not.
Who owns what is on the site
The text, the photography, the layout, the vehicle write-ups and the marks on this site belong to us or to the people who licensed them to us. Manufacturer names, model names and badges belong to the manufacturers, and we use them to say which car we are talking about, which is not a claim of any association with them.
Links to other websites
Where we link out, it is because the destination is useful. We do not control those sites and we are not responsible for what is on them.
What are you responsible for?
For this website: if we break these terms or fail to use reasonable care and skill, we are responsible for loss you suffer that is a foreseeable result of that. Foreseeable means it is obvious it will happen, or we both knew it might when you started using the site.
We do not exclude or limit our liability where the law does not allow it. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for anything else that cannot lawfully be excluded. Your statutory rights as a consumer are unaffected by anything on this page.
We do not promise that the site will always be available or free of faults, and we may suspend or withdraw it. If you are using the site for a business, we are not liable to you for loss of profit, loss of business, business interruption or loss of business opportunity.
These terms and your hire agreement
They are separate documents doing separate jobs. If anything here ever conflicts with the terms of an actual hire, the hire terms win on anything to do with that hire. Nothing on this page limits our obligations to you as a hirer under the rental terms or under consumer law.
Changes, and which law applies
Changes to these terms
We update these terms from time to time, and the date at the top changes when we do. The version that applies to your use of the site is the one published at the time. A change here never alters a hire we have already confirmed with you.
Governing law and where a dispute is heard
The governing law is being confirmed with the registration of the operating entity and will be stated here. Owner to confirm
Whatever it turns out to be, this does not change your position as a consumer. If you live in Scotland, Northern Ireland, England or Wales, you can bring proceedings in the courts of the part of the United Kingdom where you live, and you keep the protection of the consumer law that applies there.
